Terms of use
Status: working draft, 17 October 2026. These terms are not in force. They do not bind anyone until Birdfish BV publishes a version that a lawyer has reviewed and a user accepts that version. This page is not legal advice.
1. Who operates circns.com
circns.com is operated by Birdfish BV, a private limited company (besloten vennootschap / société à responsabilité limitée) incorporated in Belgium.
- Registered office: [registered office address]
- Enterprise number (KBO/BCE): [KBO number]
- Contact: [contact email]
In these terms, "circns", "we", "us" and "our" mean Birdfish BV. "The platform" means the website circns.com and the services we operate with it, including on-platform chat, email relay and contract signing.
The platform is offered worldwide. These terms and the product are in English.
2. What the platform is
circns.com is a worldwide repertoire of circus acts and shows, and a booking platform on top of it.
- Artists publish an artist profile and one or more acts or shows.
- Bookers (festivals, venues, agencies, cultural centres, corporate organisers and others) search, save shortlists, chat with artists and agree bookings. Shortlists are private to the booker. An artist is not shown how many bookers shortlisted them.
circns.com is not a party to bookings or contracts between bookers and artists. Birdfish BV is not the artist, not the booker, not an agent and not an employer. We provide the software. The booking, the fee, the performance and the contract are solely between the booker and the artist. We do not guarantee that anyone will be booked, or that a booking will go ahead.
3. Who can use it
When a reviewed version of these terms is in force, you accept them by creating an account or by continuing to use the platform. If you use the platform for an organisation, you confirm that you are allowed to bind that organisation.
You must be able to enter a binding contract. The platform is a professional tool. It is not directed at children.
4. Artist accounts and booker accounts
An account is either an artist account or a booker account. You choose the role at sign-up. You cannot change that role yourself afterwards.
There is no dual role on one account. Someone who is both (for example a circus that also programmes a festival) signs up twice, with two different email addresses.
You must give information that is accurate and keep it up to date. You are responsible for use of your account. Sign-in is handled by our authentication provider, for example a link sent to your email. Keep access to that email limited to you.
Administrator rights are never something you can switch on yourself. They are granted separately by Birdfish BV.
5. Booker accounts
Sign-up is open. There is no invite code.
A booker account is approved when it is created, whatever the email domain and whether or not the booker is in the EU. There is no administrator queue for new bookers.
The booker confirms the email address at sign-up. That confirmation is required before starting a chat or opening a contract. A booker who has not confirmed the email can still browse, search and save shortlists.
We may suspend an account that was opened with false details.
6. Profiles, acts, shows, tech riders and links
An artist can publish a profile for a solo artist, a group, a company or a circus, and any number of acts or shows. Each act or show is listed on its own. We do not approve content before it goes live.
An act or show starts as a draft. It becomes public only when you publish it, it has at least one photo, and neither it nor the artist profile is suspended. You can unpublish at any time. An act has at most 10 photos. Video is optional and may be any web link. We do not host video files. YouTube and Vimeo links can be embedded. Other links are shown as links. Stage size and a tech rider are optional. A bio has no length limit.
You are responsible for what you publish. It must not break these terms or the community rules, and you must have the rights to the text, photos, links and files.
The following are public when the relevant page is public:
- profile and act or show text, photos and references you add;
- the artist's website and social links;
- the tech rider of a public act or show. Anyone can view and download that file.
Fees are not shown on the public platform. There is no availability calendar in this version. A fee is discussed in the chat and recorded on a booking, visible only to the two parties and to administrators.
7. On-platform chat and email relay
A conversation is a chat on circns.com between one booker account and one artist profile. It may refer to a particular act or show. A booker whose email is confirmed, and an artist, can each start a chat. An artist can start a chat only with a booker whose email is confirmed.
Every message is also emailed to the other party from a circns.com relay address, sent through Resend. The relay address is not your real email, and the email we send does not reveal your real email address.
You can reply by email. A reply to that relay message is posted back into the same chat. We drop quoted history and signatures as well as we reasonably can. We reject mail that does not come from a participant in the conversation.
We do not, in this version, scan or strip phone numbers or email addresses that you type into a chat, a bio or an uploaded PDF. You are responsible for what you write. Do not put private contact details in a public field. Abuse can be reported.
We may limit how many new chats an account can open, to reduce spam.
Either party can block the other in a chat. A block stops messages in both directions.
8. Share my contact details
Account email addresses, phone numbers and relay addresses are never public.
In a chat, either party can tap Share my contact details. That shows that person's own phone number and email address to that one counterpart, inside that conversation only. It does not publish the details, it does not show them on a public page, and it does not carry them into any other chat.
In this version a share is not withdrawn once it is made. The other person may already have written the details down. Tap the control only when you mean to share.
9. Bookings, contracts and DocuSeal
When both sides agree, either side can mark the conversation as a booking and record the details you have agreed, such as the act or show, event name, venue, city, country, dates, number of shows, fee and currency, and notes.
For each booking the parties choose one of:
- the circns.com standard contract, filled in from those details; or
- a contract PDF they upload.
Signing uses DocuSeal, open-source edition, self-hosted by Birdfish BV. circns.com creates the signing request. Each party signs through their own DocuSeal link. When signing is finished, the signed copy and the audit trail are stored on the booking. They are visible only to the two parties and to administrators.
circns.com is not a party to bookings or contracts between bookers and artists. Birdfish BV does not sign the contract and does not become responsible for the booking because the signature happened through the platform. Read the contract before you sign. The standard template is a convenience. It is not legal advice, and it has to be reviewed by a lawyer before launch.
10. No payments in this version
There are no payments on circns.com in this version. There is no commission, subscription, deposit, sponsored listing or payout. Creating an account and using the platform is free.
Any fee is agreed between the booker and the artist and is paid outside circns.com. We do not hold the money, pay the artist, or collect card or bank details for a booking. Tax, insurance, travel, visas and the safety of a performance are matters for the parties.
11. Reports, removal and notice-and-action
Every artist page, every act or show page, and every chat has a Report button. Reports are reviewed by Birdfish BV administrators. Sending a report does not hide the page. The profile or act stays public until an administrator decides to remove or suspend it.
We may remove or disable content, unpublish an act or show, and suspend an artist profile or an account. We may do that where content breaks these terms or the community rules, where we believe it is illegal, or where we need to protect a person or the platform.
To notify us of content you believe is illegal, use the Report button or email [contact email]. Include where the content is, why you believe it is illegal, and how we can reach you. This is our notice-and-action process under the EU Digital Services Act. We review the notice, we may ask for anything further we need in order to assess it, and we may remove or disable access to the content. We may tell the user who posted it, unless telling them would harm the reporter or an investigation. That user can email [contact email] to dispute a removal.
Use reports in good faith. A report that is deliberately false breaks these terms.
Our contact for users and for authorities is Birdfish BV, [registered office address], [contact email].
12. Your content
You keep the rights in the content you upload. You grant Birdfish BV a non-exclusive, royalty-free licence to host, store, reproduce and display that content as needed to run and show the platform, for as long as the content stays on the platform. For a public tech rider, that includes letting any visitor view and download the file while the act or show is public.
You confirm that you have the rights you need, including in photographs of people and in any material those files contain.
Website and social links stay yours. We display the links you choose to put on the profile.
13. Community rules
The community rules, published at /community, are part of these terms. If the rules and these terms ever disagree, these terms prevail on the legal point and the rules prevail on day-to-day conduct, unless the law requires otherwise.
14. The service we actually provide
We provide the platform as it is available. Features can change, pause or be removed, including while the product is still in draft. Pages marked as drafts are not the final legal text.
We do not promise that the platform will be uninterrupted or error-free.
15. Liability
To the extent Belgian law allows it:
- we are not liable for a booking, a fee, a performance, a no-show, an injury, or any other loss that arises between a booker and an artist;
- we are not liable for content a user posts, or for a contract the parties choose to sign;
- we are not liable for indirect or consequential loss, loss of profit, loss of goodwill or loss of data arising from use of the platform.
Nothing in these terms excludes a liability that Belgian law does not allow us to exclude. That includes our own fraud or wilful misconduct, and death or personal injury caused by negligence where that liability cannot be limited. If you are a consumer, mandatory consumer rights in your country still apply.
16. Closing an account
You may stop using the platform and ask us to close your account by emailing [contact email]. We may suspend or close an account that breaks these terms or the community rules, or that we must close in order to comply with the law.
The clauses that should sensibly continue after closure continue to apply. That includes section 2 (we are not a party to bookings or contracts), section 9, section 15 and section 17, and any content that was lawfully shared before closure.
17. Belgian law and courts
These terms are governed by Belgian law.
The courts of the judicial district of Birdfish BV's registered office have jurisdiction, without taking away a mandatory right you have to sue in another court. The registered office is [registered office address]. The exact court follows once that address is filled in.
This section governs the relationship between you and Birdfish BV. It does not govern the contract between a booker and an artist. That contract follows what those two parties agree. We are not a party to it.
18. Changes
We may update these terms. We will change the date on this page and, for a material change to a version that is in force, we will give notice on the platform or by email. A lawyer has to review these terms before launch. Until we say a reviewed version is in force, this page remains a draft.
